SafeWork NSW approves EWP Code of Practice

Following the publication of the Safe Work Australia Model Code of Practice for Elevating Work Platforms in December 2025, SafeWork NSW has become the first WHS regulator to review, adopt and approve the model Code. As of July 2026, the SafeWork NSW Elevating Work Platforms – Code of Practice has been formally gazetted and is now in effect.

Another important change that should be noted is the commencement of section 26A of the Work Health and Safety Act 2011 (NSW).

With this change in effect, the EWP Code of Practice (and any other approved Codes of Practice) now represents the benchmark that a PCBU is expected to meet. In practical terms, a PCBU has a duty to comply with an approved Code of Practice unless they can demonstrate that hazards and risks are managed through an alternative approach that provides an equivalent or higher standard of health and safety.

While NSW is the first jurisdiction to approve the Code of Practice, all organisations should take the time to review their EWP policies, procedures, training, rescue planning and risk management practices in reference to this and the Model code.

Members are also encouraged to refer to the EWPA Good Practice Guide as a valuable resource that is regularly updated to reflect emerging industry knowledge, technological developments and evolving best practice. It also provides direct links to more detailed guidance documents and references Australian Standards, manufacturer information and other industry resources, making it a practical reference for implementing and maintaining effective EWP safety systems.

Safe work practices sit at the heart of the EWPA’s strategy. Used alongside the EWP Code of Practice, the EWPA Good Practice Guide gives members a clear understanding of their PCBU responsibilities while providing a practical, regularly updated resource to help them stay across the latest safe operating procedures.
