Insurance is a complex area for the hire
industry. Equipment gets used in a variety
of places and exposed to a range of risks,
so when property is damaged it can take
the eye of a good detective and the mind
of a sharp lawyer to ensure a claim is
covered and is paid in full.
That is where a good insurance broker
who understands the hire industry can be
handy. Two recent examples in Queensland
illustrate this perfectly.
CASE 1: A hire company’s premises
were invaded by water after a downpour.
Equipment was damaged. Since the
premises were beside a swollen creek, it
was initially categorised as flood damage
which was unfortunate because the hire
company was not covered for flood.
But OAMPS insurance broker Carol White
noticed debris strung along a creek-line
fence was caught on the outside of the
fence, the side facing the building.
This suggested water from the downpour
had been flowing into the creek, not
flooding out of it. On this basis the claims
manager agreed damage to the premises
and goods was caused by inundation (water
accumulating from the downpour) not by
flood. That change in definition meant a
$38,000 pay-out to the hire company.
Carol White explained: “When you are
making claims it helps to have a good
understanding of insurance definitions and
to be dealing with a very fair insurer.”
CASE 2: A tent left overnight was
vandalised; somebody had made a series
of piercing holes with a knife or other
sharp instrument. The insurers agreed the
Canberra plumbing company, A-Plus
Plumbing uses a fleet of Takeuchi machines
including two TB1140 Takeuchi 14
tonne machines, two Takeuchi 5.6
tonne TB53/153 FR’s and one Takeuchi
1.5 tonne excavator and recently
added a new Takeuchi TB285 8.5 tonne
excavator.
Operated by Tom Paton and a team
of 60, the company works mainly on
government funded projects in the ACT
area.
“The TB 285 excavator features
include adjustable service flow settings,
load sensing system and joystick with
changeable configurations.
“Even though you expect an 8.5
damage was covered by the “malicious
damage” section of the policy, but
suggested the holes could be patched.
Carol and the OAMPS team took up the
hire company’s case. They argued a hire
company offering a quality service could
not send out a patched tent. The insurance
company agreed. They provided $32,545
for a replacement tent, and allowed the
hire company to keep the damaged and
patched tent for use as a service facility.
